How it works

Who is entitled: Article 32 and the social security exception

Article 32 of the Labour Law gives a worker an end-of-service gratuity of a month's last wage for each year of actual service, whatever the reason the service ends: resignation, dismissal, including dismissal without notice under Article 28, or the end of a fixed-term contract.

It applies only to workers who aren't covered by the Social Security Law, so for a covered worker Article 32 pays nothing. An employment contract may still grant a gratuity, and the calculator shows what the Article 32 formula comes to.

What counts as the wage: Article 2

The gratuity is worked out on the last monthly wage. Article 2 defines the wage as everything the worker earns for the work, in cash or in kind, together with the other entitlements the law, the contract or settled practice provides for, except overtime pay. Fixed allowances, such as transport or housing, generally form part of the wage (Article 2), so the figure to use is the total monthly wage, not the basic salary alone.

How service length and unpaid days count

Service runs from the first day to the last working day, both counted in full. A part year earns its share, counted in days: 184 days of service are 0.5041 of a year, and earn that share of a month's wage.

Days that weren't service, unpaid leave for example, are taken off. From 1 April 2016 to 31 March 2026 with 45 unpaid days, the calculator counts 3,607 days of service.

Workers covered by social security

Article 32 doesn't apply to workers covered by the Social Security Law No. 1 of 2014, so the calculator shows the gratuity as not payable for them. It still shows what the Article 32 formula comes to, because an employment contract may grant a gratuity.

Questions about end-of-service gratuity in Jordan

How is end-of-service gratuity calculated in Jordan?
Under Article 32 of the Labour Law it's a month's last wage for each year of actual service, with a part year counted by its days. For example, a last wage of 1,000 JOD from 1 January 2020 to 30 June 2023 is 1,277 days, or 3.4986 years, and a gratuity of 3,498.630 JOD.
Who is entitled to end-of-service gratuity in Jordan?
A worker who isn't covered by the Social Security Law, whatever the reason the service ended. A worker covered by social security isn't paid it under Article 32.
Is end-of-service gratuity paid on resignation?
Yes. Article 32 pays for any reason the service ends, so resignation, dismissal and the end of a fixed-term contract all count, for a worker not covered by social security.
Does dismissal under Article 28 cancel the gratuity?
No. Article 28 lets an employer dismiss without notice in the cases it lists, but it doesn't take away the Article 32 gratuity.
I'm covered by social security. Do I get end-of-service gratuity?
Not under Article 32, which doesn't apply to workers covered by the Social Security Law. Your employment contract may still grant a gratuity. For a last wage of 900 JOD over 2,922 days of service, the Article 32 formula comes to 7,204.932 JOD.
Which wage is used: the basic salary or the total?
The last monthly wage as Article 2 defines it: everything earned for the work except overtime pay, not the basic salary alone. Fixed allowances generally form part of the wage.
Does unpaid leave count as service?
No. Unpaid days aren't service and are taken off before the gratuity is worked out. The last working day itself is counted in full.
